Aim
This privacy policy establishes the terms in which PasanaQ uses and protects the information that is provided by its users when using its mobile application. PasanaQ is committed to the security of its users’ data. This privacy policy may change over time or be updated.
Information requested and/or processed
The information requested is your name and email so that other users can identify you, the profile image (optional) of each user, your identification document (optional), your bank account (optional) so that other users can make deposits by means of bank transfer. We do not ask for any bank password or bank token. PasanaQ is only in charge of facilitating access to the information to the other users allowed by the user from whom the information is requested.
How do we process the data?
PasanaQ does not share that information with any type of entity or person outside the application. Only when you create your group with the people the user invites will the information be available to that private circle. All data is processed in the Firebase database.
How to delete your data from our platform?
To delete the data from our platform, just send an email to tecnologia@pasanaq.app indicating that you want to delete your data, along with your email with which you registered, and your full name.
The PasanaQ team will reply to the email once the data has been deleted.
Access to phone files
The application can access your phone files when creating your profile or creating a group in order to insert a profile picture of you or the group.
Money handling
The application is not a financial intermediary. There is no cash flow between users that goes through PasanaQ. Users make transfers between them through their bank account.
Denomination
User.- It is a natural person who joins the mobile platform using their personal data. The fact of becoming a “User” does not exclude that you can become a creative “User”, in addition to being able to belong to one or more groups.
Creator user.- It is a natural person who joins the mobile platform using their personal data, in order to form a group and obtain an identification number for other “Users” to join. The fact of becoming a “Creative User” does not exclude that you can become a “User”, in addition to being able to belong to one or more groups.
Game.- It consists of a collaborative savings game in which monthly contributions are made in the formed group, where the period and amount are defined by the “User” creator of the game, while the application randomly determines the order of receipt of the accumulated contribution in each Cycle, in accordance with the agreement to have PasanaQ as the first recipient.
Cycle.- Understood as the period of time in which the Contribution of each of the “Users” is made jointly (A Game with Cycles of one month is understood that each “User” must make their Contribution on that date continuously and repetitive until the end of the Game), having a minimum limit of cycles of 15 days and a maximum of two months.
Contribution.- Amount of money that the “»User» creator” defines, which must be deposited in each “Cycle”.
Contractual relationship
The purpose of this document is to determine the general terms and conditions that govern the relationship of the “User” with PasanaQ and the use of the application, from any country in the world of the application, web page, content, and services made available by the users. developers of the PasanaQ application.
PLEASE READ THESE TERMS CAREFULLY BEFORE ACCESSING OR USING THE SERVICES. These Terms and Conditions are obligatory and binding; constitutes the entire agreement between the parties, and may be subject to additional terms and conditions, applicable to the services purchased.
By accessing and using the services, you agree to be legally bound by these Conditions, which establish a contractual relationship between you and PasanaQ. If you do not agree to these Terms, you may not access or use the Services.
PasanaQ may terminate and/or interrupt at any time the PasanaQ application platform or any of the services temporarily or permanently with respect to a “User” or a group, prior report contemplating the reasons for which their access and/or account was disabled.
Every “User” declares to be aware that, by downloading and registering in the PasanaQ application, they are accepting the validity of the General Terms and Conditions of use and their subsequent modifications, updates, amendments that are published from time to time through the page website (www.pasanaq.app).
PasanaQ may apply additional conditions and they will be communicated to you in relation to the applicable services. Supplemental terms are set forth within the Terms and shall be deemed a part of the Terms, for the purposes of the applicable services. The Supplemental Terms will prevail over the Terms in the event of a conflict with respect to the applicable Services. To this end, PasanaQ will promptly inform the user regarding any change or modification previously accepted at the time of registration.
PasanaQ may modify, update and/or amend the Terms and Conditions regarding the services when it deems appropriate. They will be fully valid, effective and valid from the moment of their publication. PasanaQ will notify its “Users” by sending a notification or mail with the new document about the applicable Service. Your continued access or use of the Services after such posting constitutes your consent to be bound by the Terms as amended.
By joining as a “User” of PasanaQ you accept and authorize the use of personal data and information, such as: Name, bank account number, email, telephone number, etc.; within the application access registration requirements. The data provided to us is valid as an affidavit.
Personal information will be transcribed to a PasanaQ database, therefore you authorize the company to use this information for sending and/or receiving messages, emails and/or advertisements. In the event that the user’s personal information is available or transferred to third parties, PasanaQ undertakes to inform and obtain the user’s prior consent
PasanaQ shall have the right to deny, restrict or condition the user access to the Site and/or the application in whole or in part, at its sole discretion.
PasanaQ will not be responsible for any damage or loss of any nature that may be caused due to the lack of availability or continuity of operation of the site.
Information processing
No private information related to race, religion, ethnic origin, criminal history, sexual orientation or physical or mental health will be requested without the express consent of the user.
The information provided by the user to access the application or content will be exclusively used to personalize and improve the requested service, for which reason PasanaQ is expressly authorized to use the user’s personal information for marketing or marketing purposes or opinion consultation.
Likewise, the user authorizes the use of personal information in the protection of intellectual property rights, both of the users and of PasanaQ, or that must be disclosed by order of a competent authority.
The issuance of information, modification, update or deletion of personal data from the PasanaQ database, will be made at the express request of the user, through express communication delivered in physical form at the PasanaQ secretary who will attend to the request within 30 days of received the communication.
The User’s personal information may be shared by PasanaQ to third parties solely for the purpose of market research, attention to requests and/or as part of a commercial transaction authorized by Law, such as, merger or acquisition, sale, assignment or reorganization.
Any transfer of personal data outside the national territory will only be done if these areas have similar data protection regulations. The exception to confidentiality consists in the fact that the user’s personal information must be disclosed to any competent authority, be it police, regulatory, governmental or other regulatory authorities, provided that the established legal requirements are met.
The user, by submitting the information voluntarily through the Site or the Platform, the User declares that he accepts the conditions described above.
Treatment of minors
In accordance with the objectives and target audience of the application, PasanaQ and its users are aware of the importance of protecting the privacy of minors. Therefore, it is not intentionally directed to minors under 18 years of age, as part of PasanaQ’s policy, to request or obtain information from any person under 18 years of age.
In general, to use the PasanaQ Services, minors must have previously obtained authorization from their parents, guardians or legal representatives, who will be responsible for all acts carried out through this mobile application by minors. at your expense. In those Services in which it is expressly indicated, access will be restricted solely and exclusively to those over 18 years of age.
Object of the service
To start the service; the “User” can create a “Game” group, determine the amount and the “Cycles” of it. The application provides a code or group identifier for the members to enter the platform, with the “Creating User” being responsible for managing the entry of “User”s to the group.
Regarding the formation of the group, the “User” accepts that PasanaQ becomes part of the game, being one more participant and adding a cycle to the game (this will happen in each group created). In case of missing players, there is the option to increase the number, the group can add the “PasanaQ User”, again, being an extra player and with a total commitment to give their contributions in the established period.
After the establishment of the group, it is passed to the stage of definition of recipients of each cycle; this process is handled by the platform randomly. This as part of the main feature of the “Game”. Finally, PasanaQ is in charge of making the deposits and ensuring the receipt of the “User” corresponding to the cycle by sending the deposit receipt. The account number to which the money is formalized must be established in the application and profile of the “User”.
Service activation
The service provided by PasanaQ is free; the only condition being that PasanaQ is the initial player for the creation of a group within the platform. To join the platform, the requirements are detailed in the activation section.
PasanaQ is a mobile application; therefore all deposits must be made to the account established in the mobile application, the amount and cycle of each “Game” depends entirely on the “Creator User”. UNDER NO CIRCUMSTANCES PASANAQ HAS RESPONSIBILITY IN THE CONTROL OF CONTRIBUTIONS, DELAYS, INCOMPLETE CONTRIBUTIONS OF THE MEMBERS OF EACH GROUP. THE APPLICATION EXHORTS THE “CREATOR USERS” OF EACH GROUP TO ALLOW ACCESS ONLY TO TRUSTED “USERS”.
Services
The services constitute a mobile technology platform that allows PasanaQ “User”s to participate in the “Game”. As long as they meet all membership requirements.
To join as a “User” of PasanaQ, it is declared and guaranteed that:
You have a valid Identity Card, capacity to act and be of legal age.
Personal information will be provided at the time of registration: telephone number, address, department and city of residence.
Current and fully functioning bank account.
Email account.
PasanaQ reserves the right to verify compliance with the above requirements at any time, so for any breach, false statement or any fraudulent or contrary to law activity; PasanaQ may revoke the affiliation and take pertinent legal measures.
Restrictions
No “User” may: (i) remove any copyright, trademark or other proprietary notice from any part of the Services; You may not display or use them in any way or in a way that makes commercial or misleading use of them. (ii) channel “User”s for their own account, reproduce, modify, prepare derivative works on the Services, distribute, license, lease, transfer, publicly display, publicly perform, transmit, retransmit or otherwise exploit the Services, except as is expressly permitted by PasanaQ; (iii) decompile, reverse engineer, or disassemble the Services, except as permitted by applicable law; (iv) link to, mirror or frame any part of the Services; (v) cause or launch any program or script for the purpose of extracting, indexing, analyzing or otherwise mining data from any part of the Services or unduly overloading or blocking the operation and/or functionality of any aspect of the Services ; or (vi) attempt to gain unauthorized access to or damage any aspect of the Services or their related systems or networks.
Use of services
User account
As a “User” you agree to keep the information in your Account accurate, complete and up-to-date; failure to maintain information in this manner or failure to have a valid bank account will result in your inability to use the Services. In the event that there is no valid method when the “Game” has already started, the “User” must notify PasanaQ in the event that he decides to change the bank for his deposit, at least 5 business days in advance of any of our customer service platforms: mail, cell phone; otherwise, PasanaQ will not be responsible for the deposit made to another account.
PIN usage
The use of the pin to access the application replaces the autograph signature of the “User” for all the purposes of the applicable law. Everything that the “User” does by previously granting and/or confirming his password will be considered valid, legitimate and authorized by the “User” himself.
The “User” must take the necessary security measures to safeguard their PERSONAL IDENTIFICATION NUMBER / PIN and as the only person responsible for its use and confidentiality. It undertakes not to disclose it to third parties and to change it frequently.
User requirements and conduct
The “User” must comply with the “Contribution”, in the corresponding cycles, according to the rules established by the group in which they participate. No player may authorize or assign their account to third parties. You may not assign or otherwise transfer your account to any other person or entity. You agree to comply with all terms and conditions, you may only use the Services for legitimate purposes.
Network access and devices
The “User” is responsible for obtaining access to the data network necessary to use the services. Your mobile or fixed network messaging and data rates and rates may apply if you access or use the Services from a wireless device and/or access or use the Services from a device connected to a network, and you will be responsible for such fees. and rates. You are responsible for acquiring and updating compatible hardware or devices necessary to access and use the Services and Applications and any updates thereto. PasanaQ does not warrant that the Services, or any part thereof, will function on any particular hardware or device. In addition, the services may be subject to malfunctions or delays inherent to the use of the Internet and electronic communications.
Pay
PasanaQ does not charge any type of fee, commission, bonus or other type of financial asset for providing the service to its “User”s. However, PasanaQ enjoys participation and positioning as the FIRST turn of each “Game”. PasanaQ just communication on the website and app can start charging a fee for the game of “pasanaku”. This rate will be charged from the creation of new groups and will not have a retroactive effect for groups already formed within the mobile application.
Death of owner
IN CASE OF DEATH OF THE “USER”, the Heirs succeed the debt or the money fund, as appropriate, taking responsibility for the account of the “User” until the conclusion of the debt, if applicable, upon presentation of the declaration of heirs in accordance to Bolivian laws.
Home
Any notice, notification and in general any written communication that is issued, will be sent to the address that has been registered in the application, as well as this will also be constituted at the legal address of the “User”, in the event that some type of judicial notice if applicable.
Disclaimers, Limitation of Liability, Indemnity
Resignation
The Services are provided “as is” and “as available”. Pasanaq disclaims all representations and warranties, express, implied or statutory, not expressly set forth in these conditions, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. In addition, pasanaq makes no representation or warranty regarding the reliability, timeliness, quality, suitability or availability of the services or any of the services or goods requested through the use of the services, or that the services will not be interrupted or will be error free. Pasanaq does not guarantee the quality, suitability, safety or ability of third party providers. You agree that any risk arising from your use of the Services and any services or goods requested in connection therewith shall be solely with you, to the fullest extent permitted by applicable law.
Limitation of Liability
Pasanaq shall not be liable for indirect, incidental, special, exemplary, punitive or consequential damages, including lost profits, loss of data, personal injury or property damage, or damages relating to, or in connection with, or from otherwise arising from any use of the services, even if pasanaq has been advised of the possibility of such damages. Pasanaq shall not be liable for any damages, liability or loss arising from: (i) your use of or reliance on the Services or your inability to access or use the Services; or (ii) any transaction or relationship between you and any other user, even if pasanaq has been advised of the possibility of such damages. Pasanaq is not responsible for partial non-compliance, total non-compliance or delay in the contribution or payment of any of the fees by the users, each of the users being entirely responsible for the assembly of the groups and the payment of fees for each one of its participants.
The limitations and disclaimer in this section are not intended to limit liability or alter your rights as a consumer that cannot be excluded under applicable law.
Indemnity
The “user” of pasanaq agrees to hold harmless, indemnify, and respond to pasanaq, its partners, subsidiaries, affiliates, its directors, directors, officials, and agents for any claim, demand, loss, liability, and expense filed by a third party as consequence of the improper use by you of the pasanaq mobile application, the violation of the terms and conditions or the violation of any right of a third party. Being obliged to compensate the damages and losses caused to pasanaq for legal expenses, lawyers’ fees and any other damage that had been spent, lost profits, or emergent damage.
